This website is operated by PokeNukezNYC. Throughout the site, the terms “we”, “us” and “our” refer to PokeNukezNYC. By accessing our site, purchasing products, or participating in live sales, you agree to be bound by the following Terms of Service.

1. Online Store Terms

By using this site, you confirm that you are at least 18 years old or have permission from a legal guardian.

You agree not to use our products or services for any illegal or unauthorized purpose.

2. Nature of Business

PokeNukezNYC specializes in:

  • Trading cards (raw & graded)

  • Sealed products

  • Live auctions and breaks

  • Consignment sales

All items are sold as collectibles with fluctuating market value.

3. Live Sales & Breaks

By purchasing through live streams (TikTok, Whatnot, or other platforms), you agree:

  • All live sales are final

  • Packs/products opened live are non-refundable

  • Outcomes (pulls, card conditions, contents) are random and not guaranteed

  • No refunds or exchanges based on dissatisfaction with results

4. No Refunds / Returns Policy

All sales are final.

We do not offer returns, refunds, or exchanges for:

  • Buyer’s remorse

  • Market price changes

  • Opened or sealed products

  • Graded card disagreements

Exception:
If an item arrives damaged or incorrect, you must contact us within 48 hours of delivery with photo proof.

5. Consignment Terms

By submitting items to PokeNukezNYC for consignment, you agree to the following:

  • You confirm you are the legal owner of all submitted items

  • PokeNukezNYC has the right to market, price, and sell items at its discretion

  • Final sale price is determined by live auction, market demand, or agreed pricing strategy

Fees & Payouts:

  • A commission fee (agreed upon prior) will be deducted from the final sale price

  • Payouts are issued after the transaction is completed and payment is received from the buyer

  • Payout timelines may vary depending on platform processing times

Liability:

  • While we take care in handling items, PokeNukezNYC is not liable for:

    • Market fluctuations

    • Unsold inventory

    • Carrier-related issues after shipment

6. Pricing & Market Volatility

Trading card markets are highly volatile.

We are not responsible for changes in value before, during, or after a sale.

7. Shipping & Risk of Loss

Once an order is shipped:

  • Risk transfers to the buyer

  • We are not responsible for lost, stolen, or delayed packages

  • Tracking is always provided

8. Order Cancellations

We reserve the right to cancel any order for reasons including:

  • Suspicious activity

  • Payment issues

  • Inventory errors

9. Intellectual Property

All branding, logos, content, and media associated with PokeNukezNYC are protected and may not be used without permission.

10. Limitation of Liability

PokeNukezNYC shall not be held liable for any damages resulting from:

  • Use of products

  • Participation in live sales

  • Market losses

11. Prohibited Conduct

You agree not to:

  • Engage in fraudulent chargebacks

  • Disrupt live streams or auctions

  • Misrepresent purchases or claims

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of those changes.
